Scope of Services

The scope, deliverables, timeline, and pricing for each project will be defined in a separate proposal, quotation, invoice, or service agreement. Any work requested outside the agreed scope may be subject to additional charges.

Client Responsibilities

The client agrees to:

1. Provide all necessary content, images, logos, and information required for the project.
2. Review and approve deliverables within a reasonable timeframe.
3. Ensure that all provided materials do not infringe upon third-party copyrights, trademarks, or intellectual property rights.
4. Make payments according to the agreed schedule.

Payment Terms

1. A non-refundable advance payment may be required before project commencement.
2. Remaining payments must be made according to the agreed payment schedule.
3. Delayed payments may result in project suspension or delayed delivery.
4. Final files, source files, website credentials, or ownership transfer may be withheld until full payment is received.

Revisions and Modifications

1. The number of revisions included will be specified in the project quotation or proposal.
2. Additional revisions beyond the agreed limit may incur extra charges.
3. Major changes requested after approval may be treated as a new project.

Intellectual Property Rights

1. Upon full payment, the client will receive ownership rights to the final approved deliverables, unless otherwise stated.
2. Kreative Ginie retains the right to showcase completed work in its portfolio, marketing materials, social media, and promotional activities.
3. Any third-party assets, stock images, fonts, plugins, or software remain subject to their respective licenses.

Website Development Terms

1. The client is responsible for renewing domain names, hosting services, SSL certificates, and third-party subscriptions unless covered under a separate maintenance agreement.
2. Kreative Ginie is not responsible for downtime, security breaches, data loss, or service interruptions caused by third-party hosting providers or external services.
3. Additional features requested after project approval may require separate quotations.

SEO and Digital Marketing

1. While we follow industry best practices, Kreative Ginie does not guarantee specific search engine rankings, traffic increases, sales, leads, or marketing results.
2. Search engine algorithms and platform policies may change without notice.

Project Timeline

1. Estimated timelines are provided based on the information available at the start of the project.
2. Delays in content submission, approvals, or payments may extend project timelines.
3. Kreative Ginie will not be liable for delays caused by circumstances beyond our control.

Cancellation and Refund Policy

1. Advance payments are non-refundable once project work has commenced.
2. If the client cancels the project after work has started, payment will be due for all completed work and resources utilized up to the cancellation date.
3. Refunds, if applicable, will be determined solely at the discretion of Kreative Ginie.

Limitation of Liability

Kreative Ginie shall not be liable for any indirect, incidental, consequential, special, or financial losses arising from the use of our services, website, designs, software, or digital marketing activities.

Confidentiality

Both parties agree to maintain the confidentiality of any proprietary, business, or sensitive information shared during the project.

Third-Party Services

Projects may involve third-party tools, plugins, APIs, hosting providers, software, or platforms. Kreative Ginie is not responsible for the performance, availability, pricing, or policies of third-party services.

Warranty Disclaimer

All services are provided on an "as-is" and "as-available" basis. Kreative Ginie makes no warranties, expressed or implied, regarding uninterrupted operation, error-free performance, or specific business outcomes.

Force Majeure

Kreative Ginie shall not be held responsible for delays or failure to perform obligations due to events beyond reasonable control, including natural disasters, internet outages, government actions, pandemics, cyberattacks, or other unforeseen circumstances.

Amendments

Governing Law
